1.2 Buyer

The natural or legal person who completes a purchase on osvoy.com, declaring their name or legal name, billing address, e-mail and phone number during the order (the "Buyer"). The Buyer confirms this information is accurate and up to date.

Article 2 — Subject

This agreement sets out the rights and obligations of the parties, under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, for the sale and performance of the Osvoy Verify verification package or subscription the Buyer orders electronically on the Seller's website osvoy.com.

Article 3 — The service

  • Service: Osvoy Verify — a cloud-based software service for identity document verification, biometric face matching, liveness detection and, depending on the plan, AML screening.
  • Plan, quota and term: the plan chosen in the order (such as Pay-as-you-go or Growth); its verification quota and subscription term are shown in the order summary.
  • Price: the total price including VAT is shown at checkout and in the order summary. List prices on the Pricing page exclude VAT.
  • Payment: by credit or debit card, through the iyzico payment infrastructure.
  • Delivery: electronically, by assignment to the Buyer's account (Article 5).

The order summary and the preliminary information form are an integral part of this agreement.

Article 4 — Preliminary information

The Buyer confirms that before ordering they were informed electronically of the Seller's legal name and contact details, the main characteristics of the service, its total price including taxes, the payment and delivery method, and the right of withdrawal and when it does not apply — and that they approved this information.

Article 5 — Delivery and performance

5.1. The Seller assigns the purchased package to the Buyer's Osvoy Verify account within 24 hours of payment confirmation at the latest. There is no physical delivery or shipping.

5.2. The service counts as delivered once the package is available in the account. A purchase summary and the invoice are sent to the Buyer's e-mail address.

5.3. The Seller is responsible for providing the service as described in the order. Planned maintenance, force majeure and outages caused by third-party infrastructure are covered by the Terms of Use.

5.4. If performance becomes impossible, the Seller notifies the Buyer within 3 days of learning of it and refunds the amount paid within 14 days at the latest.

Article 6 — Obligations of the parties

6.1. The Buyer must use the service in line with applicable law — in particular KVKK (Law No. 6698), the GDPR and the relevant AML rules — inform the people being verified and obtain their explicit consent where required, and keep API keys confidential.

6.2. Roles and obligations in processing personal data are governed by the Data Processing Agreement and the Privacy Policy.

6.3. Verification results are decision-support outputs; the final decision to accept or reject rests with the Buyer.

Article 7 — Right of withdrawal

7.1. If the Buyer is a consumer, they may withdraw from the agreement within 14 days of its conclusion, without giving a reason and without paying a penalty.

7.2. Notice of withdrawal is given in writing within that period to [email protected] or through the contact form on osvoy.com.

7.3. Under Article 15(ğ) of the Distance Contracts Regulation the right of withdrawal does not apply to services whose performance began, with the Buyer's approval, before the withdrawal period ended, nor under Article 15(h) to services performed instantly in an electronic medium. The Buyer accepts that by starting the first verification after the package is assigned to their account, they approve the start of performance and lose the right of withdrawal.

7.4. On a valid notice of withdrawal, the Seller refunds the amount collected within 14 days of receiving it, by the payment method used and at no cost to the Buyer.

7.5. When the Buyer purchases as a merchant or an organisation, the consumer right of withdrawal does not apply; cancellation and refunds follow the Delivery and Return Policy and any service agreement between the parties.

Article 8 — Subscription, renewal and cancellation

8.1. Monthly subscriptions renew on the same terms at the end of each period unless cancelled, and the fee is charged to the card on file.

8.2. The Buyer may cancel at any time; cancellation takes effect from the next period. The current period's fee is not refunded, except in the cases under Article 7.

8.3. Unused verification quota does not carry over to the next period.

Article 9 — Payment security

Card payments are collected through iyzico, a licensed payment institution, with 3D Secure authentication. Card details are not stored on the Seller's servers. If a card is found to have been used without its holder's consent and the bank does not pay the Seller, the service may be suspended.

Article 10 — Force majeure

Events beyond the parties' control — natural disasters, epidemics, war, cyber attacks, infrastructure or power outages, and decisions of competent authorities — are force majeure. The parties' obligations are suspended for its duration.

Article 11 — Disputes

11.1. This agreement is governed by the law of the Republic of Türkiye.

11.2. If the Buyer is a consumer, the Consumer Arbitration Committees and Consumer Courts where they live or where the transaction took place have jurisdiction, within the monetary limits announced by the Ministry of Trade.

11.3. If the Buyer is a merchant, the courts and enforcement offices of İzmir have jurisdiction.

Article 12 — Entry into force

The Buyer confirms that before approving the order they read this agreement, understood it and approved it electronically. The agreement is concluded and enters into force when the order is approved. The Seller sends a copy to the Buyer's e-mail address; electronic records between the parties are conclusive evidence under Article 193 of the Code of Civil Procedure No. 6100.
